Absztrakt:
A gazdaság működésébe történő állami beavatkozás alapja szükségszerűen valamilyen közérdek, amely az egyénnel, illetve annak szabadságaival, jogaival szembeni korlátozó állami fellépés indokául szolgálhat. A pénzügyi stabilitás a közérdek egy megjelenési formájaként azonosítható a jogalkotásban, aminek okán a fogalom tartalmi meghatározásának igénye a jogalkotóval szemben elvárásként fogalmazódik meg, már csak azért is, mert jelentős közhatalmi típusú közigazgatási beavatkozás alapját képezi. Ezért a tanulmány elemzi a pénzügyi stabilitás fogalmának megjelenését a szakirodalomban, a jogalkotásban, valamint a jogalkalmazásban. A pénzügyi stabilitás fogalma ugyan erőteljesen megjelenik az elméleti irodalomban, sőt a jogalkotásban és a jogalkalmazásban is, tartalma azonban nehezen azonosítható, illetve folyamatosan változott. Mindezekre tekintettel a szerző javaslatot tesz a pénzügyi stabilitás általános jellegű jogi fogalmának meghatározására.
