Eltérő irányú pénzügyi szabályozások a válság után? Az EU és az Egyesült Államok válaszainak összevetése

Absztrakt:

Ennek a tanulmánynak a célja az Atlanti-óceán két oldalán adott szabályozói változások összevetése. A nem megfelelő szabályozói környezet a pénzügyi és gazdasági válság kialakulásának egyik oka volt, ezért a válság utáni szabályozás célja a korábbi hiányosságok kiküszöbölése és a válság során kialakult problémák kezelése. A tanulmány az Atlanti-óceán két oldalán nemrégiben elfogadott pénzügyi szabályozói kezdeményezéseket hasonlítja össze, és értékeli az EU-ban illetve az Egyesült Államokban tapasztalható, egymástól eltérő irányú szabályozói megközelítéseket hat kiemelt területen: javadalmazás, a banki tőkekövetelmények, származtatott eszközök, hitelminősítő ügynökségek, a fedezeti alapok szabályozása és fogyasztóvédelem. A szabályozásban meglévő alapvető különbségek kihívást jelentenek azoknak a cégeknek, amelyek mindkét környezetben működnek, a harmonizálás pedig továbbra is nehezen megoldható. Ugyanakkor bizonyos területeken a szabályozó hatóságok az Atlanti-óceán mindkét oldalán hajlandónak mutatkoznak arra, hogy széles körben elfogadják a külföldi joghatóság szabályait a sajátjaik helyett. Az Egyesült Államok és az Európai Unió közötti rendszeres párbeszédek a helyes irányba mutatnak, de ahogyan a cikk kiemeli, még nagyon sok téren kell módosítani a szabályokat ahhoz, hogy olyan konszenzust lehessen elérni, amely a pénzpiaci résztvevők és a szabályozó hatóságok számára egyaránt elfogadható.
